A man lived with his emotional support dog at a Georgia apartment complex for over a year before management gave him an “unauthorized pet” notice and tried to kick him out, according to federal court filings.Now the property owner and management company owe his family $35,000.Federal prosecutors reached a deal with property owner Johns Creek LLC and its management company, Sentinel Real Estate Inc., to settle allegations they discriminated against the renter in violation of the Fair Housing Act by ignoring his request to let the emotional support animal live with him and failing to renew his lease, the U.S. Attorney’s Office in the Northern District of Georgia said in a Jan. 21 news release.The renter died before the case was resolved, prosecutors said, meaning the money will go to his estate.“People with disabilities who need assistance animals to support them with daily activities should be allowed to keep these animals in their homes,” U.S. Attorney Kurt R. Erskine said in the release. “A person who needs the continuous support of an emotional support animal should not have to face continuous obstacles to simply keep their pet at home.”A representative for Sentinel and a lawyer representing the defendants did not immediately respond to McClatchy News’ request for comment on Tuesday, Jan. 25.Representatives for Johns Creek could not be reached for comment.According to the settlement agreement, the renter moved with his emotional support dog into an apartment at 11000 Lakefield Place in Johns Creek, Georgia, just outside of Atlanta, in April 2017. The address belongs to The Oaks at Johns Creek, a 264-unit apartment complex.The renter first received notice in August 2018 about an unauthorized pet on the premises, which prosecutors said he used as an emotional support animal to cope with a “mental health disability that limited his daily activities.”There is a difference between emotional support animals and service dogs that are trained to perform tasks for someone with a disability — such as a guide dog or seizure response dog, according to the Americans with Disabilities Act National Network. Emotional support animals are akin to therapy animals that “provide companionship, relieve loneliness, and sometimes help with depression, anxiety, and certain phobias.”The renter’s lease agreement didn’t allow dogs, court documents state, and he was put on notice regarding the pet in August 2018. He reportedly gave management a copy of his dog’s identification card under the Service Dog National Registry in response. He also followed up in October that year with a note from his doctor regarding the dog’s status as an emotional support animal.But management never responded, prosecutors said.Instead, they reportedly waited until his lease was about to expire in March 2019 and told him it would not be renewed. Court filings state they gave him until the end of April to vacate the apartment.“The Complainant did not want to move from his residence, and he sent multiple letters from several doctors to be able to renew his lease with his requested reasonable accommodation,” prosecutors said in the settlement agreement.The property owner and management company eventually agreed to sign a new lease with him that included an animal addendum. But the government said their previous actions violated the Fair Housing Act, which bars discrimination against renters and homeowners based on race, color, national origin, religion, sex and disability.The act specifically requires housing providers grant a reasonable request for accommodation regarding service and emotional support animals when there is proof of a disability and other qualifying factors are met.

Absolutely a nightmare. The office is absolutely useless. Extremely loud and inconsiderate place. Poorly built complex, cheap building materials. Absolutely a waste of money. AVOID AVOID! Stay in a tent under a bridge before coming back here.

Visited this property today with my wife cause we are looking to move due to our current apartment not working with my disability accessibility. As soon as we drive through the gate it was beautiful especially the scenery we did a quick drive around the complex it was just amazing. As we approached the leasing office for our appointment the woman was not only very professional but very knowledgeable with every question we had. As soon as she took us to do our tour we fell in love with the beautiful layout of the apartment and especially the easy accessibility we were literally sold instantly. From start of our tour throughout the the end of tour we were amazed. We applied literally as soon as we left the apartment complex hopefully I’ll get to enjoy this apartment complex in the future.

If I could give this place 100 stars, I would. Not sure why there are such low ratings, ite been the complete opposite for me. I have had previous apartment experiences that were nothing short of terrible. But from the moment we moved into The Oaks, we have been pleasantly surprised. Abby was our main source of contact when we first moved in and she was so sweet and helpful, but I think she is no longer working here. Nevertheless, Alessandra, Lorena and the Property Manager, Tina, always go above and beyond to make sure things are taken care of and are very helpful with answering any questions you may have. The property is beautiful and well kept. The maintenance staff are ON IT, unlike any other apartment Ive seen before! The property is clean with beautiful landscaping and the amenities are always well-kept and looking nice. Valet trash is amazing and super helpful. The pool/grill area is gorgeous, very relaxing and its a saltwater pool- how cool! The gym is nice and perfect for anyone needing a quick workout. Saturday mornings they have donuts in the leasing office! As far as the units themselves, I am in love with my apartment. It is huge, spacious, hardwoods and carpet and the appliances are very up to date. I feel like I live in a luxury apartment! I just renewed my lease for a second year and I wont be surprised if I stay for another after that. I truly appreciate the hard work of the staff at this apartment complex and I love living here. This place have the WORST STAFF members, rude and cruel. They never apologize and have bad reputation. Even though the apartment is well built and nice inside, the staff members are so unprofessional you will want to move out immediately after having some conversations with them. They do not know how to apologize after their mistakes. Also, they will never greet you except for the day of contract. Overall, if you want to consider a nice place to stay with a friendly staff member(this also is considered service), this is not a good place to be recommended. However, the apartment neighbors and house is nice! I have way more things to said but it will be over a page.

Dont know how anyone can give this place a 5 star rating...Staff is beyond awful and mean. Apartment is dark with no real sunlight. Anytime the apartment under me cooks i can smell it in my apartment. Not worth the money. Would never refer anyone here.

Very spacious, luxurious apartments in a nice city. The units feel private and its a relatively quiet complex. However, the gates malfunction fairly often and are sometimes unusable. They require a valet trash fee, but the trash crew doesnt always take your garbage, without reason. Minor complaint: the refreshment bar is typically dwindled down to nothing (coffee machine needs cleaning, no snacks, out of creamer, etc.). They dont keep the grounds very clean: landscaping could be better, and the breezeways could be cleaner. Maintenance crew is quick and friendly. Rent isnt bad compared to many other apartments in the area, but for the price, it could be a little nicer.

I just renewed my lease for my second year. I dont know why this place have such low reviews. I have had such a great experience here. From all the great ladies in the office to maintenance who goes over and beyond everytime. This is the only apartment complex in Johns creek that provides school buss transportation to both Northview and Shakerag top rated 10 schools. Apartments are very nice and spacious. Bonus is Valley trash pick up by your door extra $25 a month but well worth it. Grounds are extremely well taken care of for an apartment building. Pool and club house is very nice and clean. And again cant say enough about all the ladies in the office from leasing agents to managment. Always friendly and helpful. I would highly recommend this place. Almost forgot to MENTION location location!. In the heart of Johns Creek.

Matt, Ive lived here for 2yrs, how dare you say ignore these comments, theyre just disgruntled people. Thats super rude and inconsiderate because during my time here, Ive had numerous issues with management and Ive never seen you put up your dogs poop not once. I will not go into the details on my displeasure here but what I will say is Im glad Im finally moving, Ive had issues with management, work orders and maintenance, parking, and there are rotating changes in team members. I pay to live in a certain place with certain accommodations which this is not it. Ive also had a heated debate with the lady who is over the property manager, I believe the DM, her attitude is disgusting, it makes one kind of understand why the staff here dont seem to care. These beautiful apartments will hit rock bottom, if this management stays. Something is seriously wrong with this picture. Theres a reason there are low rated reviews and so many of them! I gave a 2 star because at least Vicki, the assistant property manager, makes living here tolerable, well until I move, especially with the amount of stress shes under! Thanks for everything Vicki.

I moved here for temporary corporate housing and Im glad its temporary. Management is lacking in professionalism and any basic understanding of customer service. My move in was disorganized and the property is managed inconsistently. Id like to come home to a quiet place, but I come home to unattended, screaming children running around on a daily basis. My neighbors across the hall tell me its even worse come summer. There is no insulation between the units. My car has been run into several times. Footballs are thrown at the building and hit my window on a regular basis. There is no respect for others property and management will not address this. I have found Sara and Joan to be unresponsive and ineffective. All of the construction dirt and noise across the street just adds to the headache. There are some trees and it seemed nice at first, but thats were the peacefulness ended. The property is just not well maintained. Management is only concerned with the bottom line and shows no focus on customer satisfaction or retention. Everyone is nice at move in, but its typical lip service. I dont recommend the Oaks for corporate housing. Executives would be much happier at much nicer apartments in Johns Creek that are run with good old southern hospitality. The only plus is heading into my office every day.
